NO COST TO REGISTER FOR RANDOM DRAWING; NO OBLIGATION TO PURCHASE:
There is no cost to register for the random drawing for the opportunity to purchase, subject to availability, Tickets to designated individual Pre-Season Games and 2009 Games (the "Program"). You may only register once during the Registration Period (as defined below). Registering for the Program does not guarantee that you will be selected in the random drawing and, even if selected, there will be Tickets available for purchase. Furthermore, being selected in the random drawing does not obligate you to purchase any Tickets. A registration has no cash value. Odds of a registrant being selected in the random drawing to participate in the Program depends upon the number of registrations received during the Registration Period. As used herein, "Pre-Season Game(s)" shall mean the games scheduled to be played by the New York Yankees Baseball Club (the "Club") at Yankee Stadium (the "Stadium") against the Chicago Cubs on April 3, 2009 and April 4, 2009. As used herein, "Game(s)" is defined as the MLB regular season home game(s) played by the Club at the Stadium. All Pre-Season Game and 2009 Game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and are subject to change. All Tickets purchased are subject to all policies applicable to Ticket Licenses granted by the Yankees (each a "License") generally as such policies may be determined and amended by the New York Yankees Partnership (the "Yankees"), in its sole and absolute discretion, from time to time.
TICKET PURCHASE LIMITS:
The following respective Ticket limits, subject to availability, shall apply to purchases made during the Program: (i) four (4) Tickets to any Pre-Season Game versus the Chicago Cubs; (ii) two (2) Tickets for the Opening Day Game; (iii) four (4) Tickets to any Premium Game (other than the Opening Day Game); and (iv) twelve (12) Tickets to all other Games (excluding any Premium Game). As used herein, "Premium Game(s)" is defined as the as the Opening Day Game, the Old-Timers' Day Game and all Games played against the Boston Red Sox, Los Angeles Angels of Anaheim, Cleveland Indians, Philadelphia Phillies and New York Mets.
HOW DO I REGISTER?:
To register for the Program, go online to www.yankees.com beginning 12:00 noon, March 13, 2009 and ending 10:00 p.m., March 17, 2009 (all times are Eastern Time) (the "Registration Period") and follow the instructions on the website. Complete and submit the registration form during the Registration Period. Each person may only register once, regardless of the number of e-mail addresses the on-line registrant may have.

CAN I PARTICIPATE?
The Program is open to all legal residents of the United States, the District of Columbia and U.S. Military personnel (and their families) with APO/FPO addresses who are eighteen (18) years of age or older. Participation in the Program constitutes registrant's full and unconditional acceptance of these Official Rules.
To complete a transaction via the Program, each selected registrant will be required to either create a new Ticketmaster account or login using an existing "My Ticketmaster" account. If you already have a "My Ticketmaster" account, please use your existing "My Ticketmaster" account and associated e-mail address and password to login. If you are not sure of your "My Ticketmaster" account login and password, please contact Ticketmaster or follow the Ticketmaster on-line instructions for "Forgot Password."
Only the registrant selected in the random drawing is eligible to purchase Tickets using the password issued by Ticketmaster. Passwords are non-transferable. When purchasing Tickets, the selected registrant must use the same address that such registrant provided on www.yankees.com at the time of registration. Ticketmaster will conduct a credit card validation check to verify that all account information matches up with the credit card information provided to the credit card company.
Orders exceeding the assigned per person Ticket Purchase Limits or not verified based on incorrect registration contact information or credit card validation issues will be canceled without any further notice or contact from Ticketmaster or the Yankees.
RAIN CHECK POLICY:
Tickets are not subject to any refund and shall bear no cash value. In the event a regulation game as defined by MLB (i.e., 4 1/2 innings if the Club is ahead and 5 full innings if the Club is behind or the Game is tied) is not played due to weather, an act of God or any other reason, the Ticket for the relevant Game will constitute a rain check that can either be: (i) used for admission to the rescheduled Game, if any, subject to certain double header limitations (see below); or (ii) exchanged for a same priced Ticket to any Game played in by the Club within 12 months of the originally scheduled Game, subject to availability.
In the event the rescheduled Game is part of a single admission double header, the Ticket for the Game originally scheduled to be played on the double header Game date will have priority over the rain check and the rain check can either be: (i) exchanged for the same priced Ticket for the single admission double header, subject to availability; or (ii) exchanged for a same priced Ticket for any Game played in by the Club within 12 months of the originally scheduled Game, subject to availability.
Rain check Ticket exchanges can only be made at the Stadium Advance Ticket Windows, located at Gate 4 inside the Great Hall, during normal business hours (i.e., Monday - Friday, 9:00 a.m. - 5:00 p.m.) (all times are Eastern Time). Complimentary Tickets (COMP) or equivalent Tickets bear no cash value and are not exchangeable/redeemable for any benefits that may be offered to holders of Tickets that have a dollar value. RIGHT TO CANCEL:
In the event that the operation, security or integrity of the Program or any part thereof (including without limitation, the registration process, the random drawing, etc.) is impaired in any way or for any reason, including fraud or technical problem, the Yankees may, in its sole and absolute discretion, either: (i) suspend the Program to address the impairment and then resume the Program; or (ii) select registrants at random from among the eligible registrants received up to the time of the impairment.
LIMITATION OF LIABILITY:
If a registrant selected during the random drawing declines to purchase Tickets via the Program, or in the event that any notification to such registrant is returned as undeliverable, such registrant will be disqualified and the Yankees may elect, at its own discretion, to select an alternate registrant. By participating in the Program, registrants release the Yankees, its parent, subsidiaries, affiliated businesses, its advertising and promotional agencies and each of their respective general and limited partners, owners, shareholders, members, officers, directors, employees and agents (however named or described, the "Yankees Entities") from any and all liability, damages or causes of action for injuries, damages or losses to persons and property that may be sustained in connection with receipt, enjoyment or use of any Ticket. The Yankees Entities are not responsible for: (i) any incorrect or inaccurate information, whether caused by registrants, printing errors or by any of the equipment or programming associated with or utilized in connection with the Program including, without limitation, the registration process, the random drawings, determination of selected registrants, On-Sales, the opportunity to purchase Game Tickets and any Pre-Season Game Tickets, actually purchased Game Tickets and any Pre-Season Game Tickets (collectively, the "Program Operation"); (ii) technical failures of any kind, including but not limited to the malfunctioning or unavailability of any computer, cable, network, hardware, software, Internet service or website; (iii) unauthorized human intervention in any part of the Program Operation; (iv) technical or human error which may occur in the administration of the Program Operation; or (v) any injury or damage to persons or property, including but not limited to registrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from registrant's participation in the Program Operation. . The registrant acknowledges that except and to the extent that the Yankees Entities cannot by law exempt themselves from responsibility or liability, the Yankees Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee described herein; including, but not limited to, the availability of any Tickets for purchase via the Program or otherwise. Tickets cannot be assigned, transferred, exchanged or redeemed for cash.
All Internet access and usage charges are the responsibility of the registrant. If, for any reason, the Internet portion of the registration process is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other cause which corrupts or affects the administration, fairness, integrity or proper conduct of the Program Operation, the Yankees reserve the right, in its sole and absolute discretion, to disqualify any individual who tampers with the Program Operation and/or terminate, modify or suspend the Program. All registrations received on-line before the on-line portion becomes inoperable because of any of the foregoing will be included in the on-line drawing. The Yankees Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, unauthorized access to or alteration of entries. The Yankees Entities are not responsible for any problems or technical malfunctions of any cable network or lines, telephone network or lines, computer on-line systems, servers or providers, computer equipment, hardware or software, failure of any e-mail or registration to be received on account of technical problems, human error or traffic congestion on the Internet or at any web-site, or any combination thereof, including any injury or damage to registrant's or any other person's computer related to or resulting from participation in the Program Operation. In the event of a dispute, eligible electronic registrations will be considered made by the authorized account owner of the e-mail address submitted at the time of registration. Registrations generated by robots or scripts will result in immediate disqualification of any and all associated registrations. The Yankees Entities are not responsible for printing errors in these Official Rules.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE PROGRAM OPERATION IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE YANKEES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to the identity of a registrant selected to participate in the Program based on an e-mail address, the authorized account holder of the e-mail address that submitted the registration first will be declared the selected registrant. "Authorized Account Holder" is defined as the person who is assigned the e-mail address by an Internet service provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Except as otherwise provided in these Official Rules and where prohibited, each registrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with the Program Operation shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court located in the Southern District of New York or State of New York court located in Bronx County; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with registering, but in no event attorney's fees; and (c) under no circumstances will any registrant be permitted to obtain awards for, and registrants hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligation of the registrants and the Yankees in connection with the Program Operation shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
RESALE OF TICKETS:
Any direct or indirect sale, resale, auction, assignment or transfer (collectively, "resale") must be done in accordance with applicable law. Any resale or attempted resale in violation of applicable law violates the License. A Ticket may not be resold within one thousand five hundred feet (1,500) from the Stadium under penalty of law. Tickets may not be used for advertising, promotion (including contest, giveaways or sweepstakes) or other trade or commercial purposes without the express written consent of the Yankees. Any violation of the License shall give the Yankees the unrestricted right to revoke the License, terminate the License and/or cancel the Ticket Account immediately without having to refund the established price (i.e., the face value) of the Ticket. The use of the Ticket for commercial or other transactions involving the Ticket in violation of the License, with or without the knowledge of the Licensee, is the sole responsibility of the Licensee, who shall remain absolutely and unconditionally responsible for any violation of the License. Accordingly the Licensee should control and supervise the use of the Ticket(s) so that the License is not violated. The Licensee is absolutely responsible for any violation of the License and should safeguard this Ticket so that the License is not violated. The Yankees reserve the right to investigate violations and/or alleged violations of the License. The failure of the Licensee or any person in possession of the Ticket to cooperate with any investigation constitutes a violation of the License.
DURING ALL BATTING PRACTICES, FIELDING PRACTICES, WARM-UPS AND THE COURSE OF THE GAME EXPERIENCE, HARD HIT BASEBALLS AND BATS AND FRAGMENTS THEREOF MAY BE THROWN OR HIT INTO THE STANDS, CONCOURSES AND CONCESSIONS AREAS. FOR EVERYONE'S SAFETY, PLEASE STAY ALERT AND BE AWARE OF YOUR SURROUNDINGS. ANY GUEST WHO IS CONCERNED WITH HIS OR HER SEAT LOCATION SHOULD CONTACT ANY CUSTOMER SERVICE REPRESENTATIVE FOR AN ALTERNATE SEAT LOCATION. The bearer of the Ticket assumes all risk and danger incidental to the sport of baseball and all warm-ups, practices and competitions associated with baseball, including specifically (but not exclusively) the danger of being injured by thrown bats, fragments thereof, and thrown or batted balls and agrees that neither the Yankees Entities, the state and city of New York and their various agencies, departments and subdivisions, the Office of the Commissioner of Baseball, MLB Enterprises, Inc., MLB Properties, Inc., MLB Advanced Media, L.P., the Major League Clubs nor any of their respective managers, agents, players, officers, directors, partners, employees and owners shall be liable for any injuries or loss of personal property resulting from such causes.
ENTERING THE PLAYING FIELD, DISRUPTING A GAME AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH A GAME PARTICIPANT IS A CRIME PUNISHABLE BY FINE AND/OR IMPRISONMENT, AS WELL AS A CIVIL PENALTY OF UP TO $25,000. VIOLATORS WILL BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.
