OFFICIAL RULES: ONLINE OPPORTUNITY TO PURCHASE 2008 REGULAR SEASON -
PREMIUM GAME REGISTRATION TERMS AND CONDITIONS.
Register at www.yankees.com to be considered for an opportunity to purchase up to four (4) Tickets to each of the designated 2008 Major League Baseball ("MLB") regular season Premium Games that may be played at Yankee Stadium (the "Stadium"). There is no cost to register to be considered for the opportunity to purchase Premium Game Tickets. There is no obligation to purchase any Premium Game Tickets. The term "Game(s)" is defined as the MLB regular season home game(s) played by the New York Yankees (the "Yankees") Baseball Club in the Stadium. The term "Premium Games" is defined as the Opening Day Game, the Old-Timers' Day Game, the final three (3) regular season Games scheduled to be played at the Stadium and all Games played against the following teams: (i) Boston Red Sox and (ii) New York Mets. You may register only once and must register between 12:00 noon EST, February 6, 2008 and 10:00 p.m. EST, February 24, 2008 (the "Registration Period"). Registrations have no cash value. Odds of an Online registrant being selected for the opportunity to purchase Premium Game Tickets depends upon the number of registrations. All 2008 Premium Game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and are subject to change. All Premium Game Tickets purchased are subject to those policies applicable to Yankees Ticket Licenses generally; as such policies may be determined by the Yankees, in its sole and absolute discretion, from time to time.

This registration is open to all legal residents of the United States, the District of Columbia, and U.S. Military personnel (and their families) with APO/FPO addresses, who are eighteen (18) years of age or older. Participation in this registration constitutes registrant's full and unconditional acceptance of these Official Rules.
HOW DO I REGISTER?
Access the Yankees' website (www.yankees.com) during the Registration Period and register to be considered for the opportunity to purchase 2008 Premium Game Tickets by following the instructions on the site. Complete the registration form and click to submit during the Registration Period. Each person may only register once, regardless of the number of e-mail addresses the Online registrant may have.
WHAT HAPPENS AFTER I REGISTER?
2008 Regular Season - Premium Game
An Online Drawing will take place on February 25, 2008, at which time certain Online registrants will be selected for the opportunity to purchase, Online, up to four (4) Tickets to any 2008 Premium Game that may be played in the Stadium. The Ticket purchase opportunity will only take place on the Onsale Date - February 26, 2008.
Online registrants who are selected as a result of the February 25, 2008 Online Drawing will receive an e-mail notification that includes a password and instructions for participating in the opportunity to purchase 2008 Premium Game Tickets. If the selected registrant chooses to purchase Tickets, the purchase must be completed Online, while Tickets are available, but in no event later than 10:00 p.m. EST, February 26, 2008. NOTE: There is no obligation for a selected Online registrant to purchase any Tickets.
AT TIME OF PURCHASE:
To complete a transaction on either Onsale Date, each registrant will be required to either create a new Ticketmaster account or login using an existing "My Ticketmaster" account. If you already have a "My Ticketmaster" account, please use your existing "My Ticketmaster" account and associated e-mail address and password to login. If the registrant is not sure of the "My Ticketmaster" account login and password, please contact Ticketmaster or follow the Ticketmaster Online instructions for "Forgot Password."
Only the registered person is eligible to purchase Tickets using the password issued by Ticketmaster. Passwords are non-transferable. When purchasing Tickets, the registrant must use the same address provided onwww.yankees.com at the time of registration. Ticketmaster will conduct a credit card validation check to verify that all account information matches up with the credit card information provided to the credit card company.
Orders exceeding the assigned per person Ticket limits or not verified based on incorrect registration contact information or credit card validation issues will be canceled without contact from Ticketmaster or the Yankees.
If any 2008 Premium Game Tickets remain unsold after the February 26, 2008 Onsale Date, they will be made available to the general public, Online only, at www.yankees.com beginning 10:00 a.m. EST, February 29, 2008.
RAIN CHECK POLICY:
Tickets are not subject to any refund and shall bear no cash value. In the event a legal Game, as defined by MLB (i.e., 4 1/2 innings if the Yankees are ahead and five full innings if the Yankees are behind or the game is tied), is not played due to weather, an act of God, or any other reason, the Ticket will constitute a rain check that can be either: (i) used for admission to the rescheduled Game, if any, subject to certain double header limitations (see below), or (ii) exchanged for a same priced Ticket for any regular season Yankees home Game within 12 months of the originally scheduled Game, subject to availability.
In the event the rescheduled Game is part of a single admission double header, Tickets for the Game originally scheduled to be played on the double header Game date will have priority over the rain check and the rain check can be either: (i) exchanged for the same priced Ticket for the single admission double header, subject to availability, or (ii) exchanged for a same priced Ticket for any regular season Yankees home Game within 12 months of the originally scheduled Game, subject to availability.
Rain check Ticket exchanges can only be made at the Stadium Advance Ticket Windows, located between Gate 4 and Gate 6, during normal business hours. Complimentary Ticket(s) (COMP) or equivalent Tickets bear no cash value and are not exchangeable/redeemable for any benefits which may be offered to Ticket(s) with a dollar value. RIGHT TO CANCEL:
In the event that the operation, security, or integrity of this registration is impaired in any way for any reason, including fraud or technical problem, the Yankees may, in its sole discretion, either (a) suspend this registration to address the impairment and then resume the registration; or (b) select registrants at random from among the eligible registrants received up to the time of the impairment.
LIMITATION OF LIABILITY:
If a selected registrant declines to purchase Premium Game Tickets, or in the event that any notification is returned as undeliverable, the selected registrant will be disqualified and the Yankees may elect, at its own discretion, to select an alternate registrant. By participating, registrants release the New York Yankees Partnership, its parent, subsidiaries, affiliated businesses, its advertising and promotional agencies and the general and limited partners, officers, directors, employees and agents of each (however named or described, the "Yankees Entities") from any and all liability, damages or causes of action for injuries, damages or losses to persons and property which may be sustained in connection with receipt, enjoyment, or use of the Premium Game Tickets. The Yankees Entities are not responsible for: (a) any incorrect or inaccurate information, whether caused by registrants, printing errors or by any of the equipment or programming associated with or utilized in the registration process; (b) technical failures of any kind, including but not limited to the malfunctioning or unavailability of any computer, cable, network, hardware, software, Internet service or website; (c) unauthorized human intervention in any part of the registration process, drawings, determination of selected winners, Onsales, the opportunity to purchase Premium Game Tickets or any Premium Game Tickets purchased; (d) technical or human error which may occur in the administration of this registration process, drawings, determination of selected winners, Onsales, the opportunity to purchase Premium Game Tickets or any Premium Game Tickets purchased; or (e) any injury or damage to persons or property, including but not limited to registrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from registrant's participation in the registration process, drawings, determination of selected winners, Onsales, the opportunity to purchase Premium Game Tickets or any Premium Game Tickets purchased. The registrant acknowledges that except and to the extent that the Yankees cannot by law exempt itself from responsibility or liability, the Yankees have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee described herein; including, but not limited to, the availability of any Premium Game Tickets for purchase. Premium Game Tickets cannot be assigned, transferred, exchanged or redeemed for cash.
All Internet access and usage charges are the responsibility of the Online registrant. If, for any reason, the Internet portion of the registration process is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other cause which corrupts or affects the administration, fairness, integrity or proper conduct of the registration process, the Yankees reserves the right, in its sole discretion, to disqualify any individual who tampers with the registration process and/or terminate, modify or suspend the registration process. All registrations received Online before the Online portion becomes inoperable will be included in the Online Drawing. The Yankees assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, unauthorized access to or alteration of entries. The Yankees is not responsible for any problems or technical malfunctions of any cable network or lines, telephone network or lines, computer Online systems, servers or providers, computer equipment, hardware or software, failure of any e-mail or registration to be received by the Yankees on account of technical problems, human error or traffic congestion on the Internet or at any web-site, or any combination thereof, including any injury or damage to registrant's or any other person's computer related to or resulting from participation in the registration. In the event of a dispute, eligible electronic registrations will be considered made by the authorized account owner of the e-mail address submitted at the time of registration. Registrations generated by robots or scripts will result in immediate disqualification of any and all associated registrations. The Yankees are not responsible for printing errors in these Official Rules.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE REGISTRATION PROCESS IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE YANKEES RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a selected registrant based on an e-mail address, the authorized account holder of the e-mail address that submitted the registration first will be declared the selected registrant. "Authorized Account Holder" is defined as the person who is assigned the e-mail address by an internet service provider, Online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Except where prohibited, each registrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this registration process, drawings, determination of selected winners, Onsales, the opportunity to purchase Premium Game Tickets or any Premium Game Tickets purchased shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court located in the Southern District of New York or State of New York court located in Bronx County; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with registering (like what?), but in no event attorney's fees; and (c) under no circumstances will any registrant be permitted to obtain awards for, and registrants hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligation of the registrants and the Yankees in connection with the registration process, drawings, determination of selected winners, Onsales, opportunity to purchase Premium Game Tickets or any Premium Game Tickets purchased, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
RESALE OF TICKETS:
Any direct or indirect sale, resale, auction, assignment or transfer (collectively, "resale") of Tickets must be done in accordance with applicable law. Any resale or attempted resale in violation of applicable law violates the License. New York State law prohibits the resale of any Tickets within one thousand five hundred (1,500) feet from the physical structure of the Stadium under penalty of law. No Tickets may be used for advertising, promotion (including contests, giveaways or sweepstakes), or other trade or commercial purposes without the prior express written consent of the Yankees. Any violation of the License shall give the Yankees the unrestricted right to revoke the License, terminate the License and/or cancel the Ticket Account immediately. The Licensee is absolutely responsible for any violation of the License and should safeguard the Tickets so that the License is not violated. The Yankees reserve the right to investigate violations of the License. The failure of the Licensee or any person in possession of the Tickets to cooperate with any investigation constitutes a violation of the License.
WARNING: DURING ALL BATTING PRACTICES, FIELDING PRACTICES, WARM-UPS AND THE COURSE OF THE GAME EXPERIENCE, HARD HIT BASEBALLS AND BATS AND FRAGMENTS THEREOF MAY BE THROWN OR HIT INTO THE STANDS. FOR EVERYONE'S SAFETY, PLEASE STAY ALERT AND BE AWARE OF YOUR SURROUNDINGS. ANY GUEST WHO IS CONCERNED WITH HIS OR HER SEAT LOCATION SHOULD CONTACT ANY CUSTOMER SERVICE REPRESENTATIVE FOR AN ALTERNATE SEAT LOCATION. TIME, OPPONENT, DATE AND CLUB ROSTERS AND LINEUPS, INCLUDING THE NEW YORK YANKEES ROSTER AND LINEUP, ARE SUBJECT TO CHANGE. The bearer of the Ticket assumes all risk and danger incidental to the sport of baseball and all warm-ups, practices and competitions associated with baseball, including specifically (but not exclusively) the danger of being injured by thrown bats, fragments thereof, and thrown or batted balls and agrees that neither the Office of the Commissioner of Baseball, MLB Enterprises, Inc., MLB Properties, Inc., MLB Advanced Media, L.P., the Major League Clubs, nor any of their respective agents, players, officers, employees and owners shall be liable for injuries or loss of personal property resulting from such causes.
ENTERING THE PLAYING FIELD, DISRUPTING A GAME AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH A GAME PARTICIPANT IS A CRIME PUNISHABLE BY FINE AND/OR IMPRISONMENT, AS WELL AS A CIVIL PENALTY OF UP TO $25,000. VIOLATORS WILL BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.
