FUTURE GAME TICKET EXCHANGE PROGRAM

The New York Yankees ("Yankees") permit Full and Partial Season Ticket Plan Licensees to exchange Tickets for Games within their Ticket License Plan for Tickets for any of the 40 predetermined Games designated as "Future Ticket Exchange Games" during the 2013 Regular Season, subject to availability and specific rules, regulations, limitations and guidelines pertaining to the Future Game Ticket Exchange Program. Ticket Licensees are limited to a designated amount of exchanges per month.

2013 Regular Season Future Game Ticket Exchange Program Rules, Regulations, Limitations and Guidelines:

(a) A Premium Game Ticket within a Ticket Licensee's Plan may only be exchanged for one of the 40 designated Future Ticket Exchange Games, excluding Premium Games. For the 2013 Regular Season, the term "premium games" is defined as the Opening Day game, the Old-Timers' Day game and all home games played against the Boston Red Sox, Los Angeles Dodgers, New York Mets and San Francisco Giants.

(b) Friday, Saturday and/or Sunday Game Tickets within a Ticket Licensee's Plan may only be exchanged for one of the 40 designated Future Ticket Exchange Games, excluding Premium Games. Ticket Licensees may not exchange more than two (2) Friday, Saturday and/or Sunday Games, in the aggregate, per month.

(c) A Monday-Thursday Game Ticket within a Ticket Licensee's Plan may only be exchanged for a Monday-Thursday Game within the 40 designated Future Ticket Exchange Games, excluding Premium Games.

Please be advised that the number of designated Future Ticket Exchange Games per month, in the aggregate, exceeds the total number of designated Future Ticket Exchange Games during the 2013 Regular Season; however, Ticket Licensees may not exchange, in the aggregate, more than the number of Tickets reflected in the schedule set forth above under the column Season Aggregate.

• Exchanges of Tickets for Games under the Future Game Ticket Exchange Program may only be made by a Ticket Licensee. A Ticket Licensee may only exchange a Ticket for the same priced or a higher-priced Ticket. A Ticket Licensee may not exchange a Ticket for a Ticket in the Audi Yankees Club. Further, if the new Ticket has a value that is greater than the value of the original Ticket being presented for exchange, the difference in price can be paid only by cash or credit card. No "downgrades" will be permitted; that is, a Ticket cannot be exchanged for a Ticket with a lesser value than the Ticket being exchanged. The Yankees will not issue multiple Tickets or Bomber Bucks as part of an exchange process. For example, Ticket Licensees will not be permitted to exchange a Field Level Ticket for a Grandstand Level Ticket and obtain additional Tickets or Bomber Bucks for the difference in the Ticket prices. All Ticket exchanges are final, and Ticket Licensees may not exchange Tickets obtained during the exchange process for other Tickets.
• Ticket Licensees, when exchanging Tickets, will be charged for the exchanged Ticket at the pricing that is comparable to the pricing that the Ticket Licensee is charged for Tickets under his/her/its Full or Partial Season Ticket Plan. If a Ticket Licensee upgrades to acquire a Premium Ticket (i.e., Legends Suite, Champions Suite, Delta SKY360° Suite, Jim Beam Suite) during the exchange process, the advance Ticket price will be charged for the Premium Ticket.
• A Value Game Ticket within a Ticket Licensee's 9 Game Value Plan may only be exchanged for another one of the 9 designated Value Games. Ticket Licensees who would like to exchange their tickets for another one of the designated 40 Future Game Ticket Exchange games can do so by paying the difference between the Value Plan and Partial Plan price.
• The original Tickets within a Full or Partial Season Ticket Plan must be returned during the exchange process. Tickets being exchanged may not be exchanged for Group or single Game Tickets.
• The Tickets within a Full or Partial Season Ticket Plan may neither be combined so as to be exchanged for Tickets in a higher price category nor be exchanged for multiple Tickets in a lower price category.
• Individual Game Tickets, Group Tickets, "COMP" Tickets, Tickets that bear no cash value and any other type of Tickets (other than set forth herein) are not part of the 2013 Regular Season Future Game Ticket Exchange Program and may not be exchanged.
• The Yankees will not exchange Ticket for Games that have already been played.
• A Ticket that a Ticket Licensee wishes to exchange must be exchanged no less than 14 days prior to the date of the Game for which the Ticket is being exchanged. For example, a Ticket Licensee that is desirous of exchanging a Ticket for the Game scheduled for July 26, 2013, must present that Ticket for exchange on or before July 12, 2013.

Commencing in late March, Tickets may be exchanged at the Yankee Stadium Ticket Office, adjacent to Gate 4, Monday through Saturday, 9 a.m. to 5 p.m. Eastern time, and Sunday, 10 a.m. to 4 p.m. Eastern time. On Game days, Ticket Licensees may exchange Tickets at Yankee Stadium Ticket Windows across from the Yankees Team Store behind home plate in the Great Hall until two hours after the scheduled start time for the Game.

All Ticket exchanges are subject to availability. Mail-order Ticket exchanges will not be accepted.

The Yankees' rainout policy supersedes the 2013 Regular Season Future Game Ticket Exchange Program for Ticket Licensees.

ENHANCED FUTURE GAME TICKET EXCHANGE PROGRAM-NEW FOR 2013

Through the Enhanced Future Game Ticket Exchange Program, Full Season Licensees with 10+ years of seniority receive an additional 10 predetermined games designated as Future Ticket Exchange Games to choose from when exchanging tickets for games within their ticket license plans, subject to availability and specific terms and conditions.
